Step 11: Entering Judgment in default


The Defendant has 14 days (28 days if an acknowledgement is filed) to serve a defence.

If the Defendant does not respond within time you can ask the Court to enter "judgment in default". This means that the Court will make an order requiring the Defendant to pay you the amount you have claimed.

Apply to the Court using the form supplied to you when you issue the claim. Act quickly because the Defendant will still be able to defend the claim right up until the Court receives your request for judgment to be entered.

Once judgment in default has been obtained a copy will be sent to you and the Register of County Court Judgments. The register is run by Registry Trust Ltd which maintains a record of County Court Judgments (CCJ's) frequently used by credit industry.

If judgment in default is entered the Defendant may apply to the court to have it set aside.
