Step 3: The rules of the small claims court
The CPR The procedure of the County Court is laid down by the Civil Procedure Rules 1998. These rules are frequently referred to as the "CPR". The Small Claims Track has its own set of rules which tend to be more simple and straightforward then the rules which apply to the other tracks. The system has been specifically designed with the layman in mind. People are encouraged to do without professional legal advice or representation. Instead, it aims to enable civil disputes to be resolved in a speedy, efficient and cost effective way. An attempt has been made to keep the procedural steps to a minimum and the final hearing itself is a relatively informal affair where the strict rules of evidence do not apply. What is CPR Part 27? If you are bringing or defending a claim in the Small Claims Court it is not necessary for you to be familiar with the Civil Procedure Rules. However, you may find it helpful to read or refer to Part 27 of the CPR. This is the section of the rules that deals specifically with the conduct of Small Claims. You can find Part 27 reproduced in full by selecting the appropriate icon in the DYJ tool kit on the left. However be warned, you may wish to make yourself a pot of strong coffee before you begin! The CPR does not make easy reading and can make some flat pack instructions seem like plain English. But if you persevere you are likely to be rewarded for your efforts.
